Attendance Terms

KENILWORTH RACING PROPRIETARY LIMITED (REGISTRATION NO.: 2011/008903/07) (”THE COMPANY”) IS THE OWNER AND OPERATOR OF HOLLYWOODBETS DURBANVILLE RACECOURSE (”THE PREMISES”)

By entering or attempting to enter the Premises, you (and any persons under the age of 18 accompanying you) will enter into a contract with the Company on:

  • these terms and conditions, including any related signage at the Premises setting out prohibited items or activities, and
  • the further TERMS AND CONDITIONS SET OUT ON THE WEBSITE of the Company from time to time, accessible at https://caperacing.co.za/terms-conditions/.

THE COMPANY RESERVES THE RIGHT TO DENY ANY PERSON ENTRY INTO OR EJECT ANY PERSON FROM THE PREMISES FOR ANY REASON, INCLUDING IF SUCH PERSON CHOOSES NOT TO CONSENT TO ANY REASONABLE SEARCH REQUIREMENTS.

IF YOU DO NOT COMPLY WITH THESE TERMS AND CONDITIONS, THE COMPANY MAY BAN YOU FROM ENTERING THE PREMISES IN FUTURE FOR ANY PURPOSE.

YOU AGREE THAT YOU ENTER AND USE THE PREMISES ENTIRELY AT YOUR OWN RISK.

THE COMPANY (AND ITS SHAREHOLDERS, DIRECTORS, OFFICIALS, AGENTS, REPRESENTATIVES AND/OR EMPLOYEES) WILL NOT BE LIABLE OR HELD RESPONSIBLE TO YOU OR ANYBODY ELSE FOR ANY CLAIMS FOR LOSS, INJURY, DEATH OR DAMAGE OF WHATSOEVER NATURE AND HOWSOEVER ARISING WHICH MAY BE SUFFERED OR INCURRED BY YOU AT THE PREMISES.

YOU INDEMNIFY THE COMPANY, ITS SHAREHOLDERS, DIRECTORS, OFFICIALS, AGENTS, REPRESENTATIVES AND EMPLOYEES AGAINST ANY CLAIM FOR ANY LOSS, INJURY OR DAMAGE OR WHATSOEVER NATURE ARISING FROM OR IN CONNECTION WITH ANY CLAIM REFERRED TO IMMEDIATELY ABOVE.

Filming & Photography

PLEASE NOTE THAT PHOTOGRAPHS AND VIDEO FOOTAGE WILL BE TAKEN AT EVERY EVENT. 

By entering the event premises, you consent to interview(s), photography, audio recording, video recording and their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Cape Racing and its affiliates and representatives. 

You release Cape Racing, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged.  

YOU HAVE BEEN FULLY INFORMED OF YOUR CONSENT, WAIVER OF LIABILITY, AND RELEASE BEFORE ENTERING THE EVENT.
